As a seasoned bankruptcy and creditor’s rights attorney, I regard the filing of a Chapter 11 case as a last resort. A negotiated workout of troubled business debt should be explored whenever practicable. If a negotiated workout can be achieved, the result is invariably better, faster and more controllable and avoids the numerous layers of professional fees that would burden a Chapter 11 case.
